l ENCLOSURE NOTICE OF DEVIATION 1

Omaha Public Power District Docket No.: 50-285 Fort Calhoun Station License No.: DPR-40 During an NRC inspection conducted on November 31 through December 4,1998, one deviation of your commitment to NRC Bulletin 79-19 was identified. In accordance with the l

" General Statement of Policy and Procedure for NRC Enforcement Action," NUREG-1600, the deviation is listed below; i The licensee stated in their September 21,1979, response to NRC Bulletin 79-19, that the Quality Assurance Department would conduct an annual audit of all transfer, packaging, and transport activities involving radioactive materials.

Contrary to the above, from 1986 to 1998, the licensee's Quality Assurance Department l

conducted biennial audits of all transfer, packaging, and transport activities involving )

radioactive materials.

The NRC has concluded that information regarding the reason for the deviation, the corrective actions taken and planned to correct the deviation and prevent recurrence, and the date when full compliance will be achieved are already adequately addressed on the docket in the enclosed inspection report. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your l corrective actions or your position. In that case, or if you choose to respond, clearly mark your l response as a " Reply to a Notice of Deviation," and send it to the U.S. Nuclear Regulatory j Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the  ;

and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Deviation (Notice).
