AND NOTICE OF VIOL.ATION

Dear Mr. Miller:

On November 2,1997, the NRC completed an inspection at your Portsmouth Gaseous Diffusion Plant. The enclosed report presents the results of that inspection. The results of ourinspection over a six-week period covered by the enclosed report indicate that the facility was operated in a safe manner.

Five violations of NRC requirements were identified during the inspection period. Two of the violationi, indicate continued problems with implementation of nuclear criticality safety requirements. We will monitor your activities with regards to the corrective action pan that you have implemented.

The violations are cited in the enclosed Notice of Viol & tion (Notice) and the circumstances surrounding the violations are described in detailin the enclosed report. You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements, in accordance with 10 CFR 2.790 of the NRC's " Rules of Practice" a copy of this letter, its enclosures, and your response will be placed in the NRC Public Document Room (PDR).
