NRC INSPECTION REPORT 70-7002/99004(DNMS) AND NOTICE OF VIOLATION

Dear Mr. Adkins:

On March 12,1999, the NRC completed a three-week inspection of activities associated with

. the Corrective Action Program, and your application of this program to the Nuclear Criticality Safety Corrective Action Plan at the Portsmouth Plant. At the conclusion of the onsite inspection and on April 28,1999, the inspectors discussed the findings with members of your -

staff. The enclosed report presents the results of the inspection.

Based upon the results of this inspection, the NRC has determined that, in general, the Corrective Action Program was adequately developed and implemented. However, the inspection results also indicated that the Corrective Action Program was not being rigorously applied to your Nuclear Criticality Safety Corrective Action Plan to ensure the effective and comprehensive resolution of previously identified problems. Specifically, the NRC determined that four violations of NRC requirements occurred as a result of inadequate implementation of corrective actions for problems previously identified with the Nuclear Criticality Safety Program.

The violations are cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding the violations are described in detail in the enclosed report.

The violations are of significant concem because the violations indicated a lack of: 1) rigor by your staff in the completion of some corrective actions for issues which were, in part, the basis for previous enforcement action; 2) adequate knowledge and understanding by some staff and i

management of the corrective action process; and 3) adequate management oversight to ensure that the corrective actions were completed and modified in accordance with I

requirements of the Corrective Action Program. In addition, the inspection results identified concems with the timeliness and completeness of your staff's handling of issues developed during an external review of the Nuclear Criticality Safety Program.
