NRC INSPECTION REPORT 70-7002/99001(DNMS) AND NOTICE OF VIOLATION

Dear Mr. Adkins:

On February 22,1999, the NRC completed a routine resident inspection at your Portsmouth Gaseous Diffusion Plant. The purpose of the inspection was to determine whether activities authorized by the cedificate were conducted safely and in accordance with NRC requirements.

At the conclusion of the inspection, the inspectors discussed the finding with members of your staff.

Areas examined during the six week inspection period are identified in the report. Within these areas, the inspection consisted of a selective examination of procedures and representative records, interviews with personnel,' and observations of activities in progress. Based on the results of the inspection, the NRC has determined that a violation of NRC requirements occurred. In addition, issues relative to your shipment of an empty uranium hexafluoride cylinder with radiation levels in excess of NRC transportation limits were raised during this inspection. Pending'further review by the NRC, these transportation issues will be tracked as an Unresolved item.

The violation is cited with two examples in the enclosed Notice of Violation (Notice) and the circumstances surrounding the violation are described in detailin the enclosed repod. The violation is of concern because your staff returned systems to service following safety actuations without appropriately documenting the safety actuations and understanding the root cause of the safety actuations. In one instance, your staff did not take appropriate actions to prevent recurrence of the safety actuation untilintervention by NRC staff.

You are required to respond to this letter and should follow the instructioris specified in the enclosed Notice when preparing your response. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter and its enclosures will be placed in the NRC Public Document Room.
