PORTSMOUTH GASEOUS DIFFUSION PLANT (PORTS): RECEIPT OF CERTIFICATE AMENDMENT REQUEST REGARDING REOPENING OF COMPLlANCE PLAN ISSUES 8,9 AND 23 (TAC NO. L32123) )

Dear Mr. Adkins:

We have received your application dated May 14,1999, as amended by your letter dated May 21,1999, to reopen issues 8,9 and 23 of The Plan for Achieving Compliance with the U.S.

Nuclear Regulatory Commission (NRC) Regulations at the Portsmouth Gaseous Diffusion Plant (Compliance Plan). Your request has been assigned TAC No. L32123. Please reference this number in any future correspondence associated with this request.

We have completed the initial administrative review of your application to amend your PORTS certificate by reopening issues 8,9 and 23 of the PORTS Compliance Plan. No administrative l omissions or deficiencies were identified, therefore, we have administratively found it  !

acceptable for formal review. However, please note that the NRC staff finds the latest nuclear criticality safety (NCS) corrective actions program schedule slippage for reviewing and implementing 27 Priority 2 nuclear criticality safety evaluations (NCSEs) and nuclear criticality safety approvals (NCSAs) from March 3,2000, to July 30,2000, to be unsubstantiated. Based on our review to date, our issuance of the amendment would include the March 3,2000, date.

As such, please revise the completion date for this task back to March 3,2000, and provide it to us within 14 calendar days of this letter. We also note that as part of an NCS inspection, we will be assessing the adequacy and the application of the criteria used to deterrnine which NCSEs and NCSAs need complete reviews. Other issues and concerns may ise identified in our detailed technical review of the submitted information.

Based on our administrative reviews and projection of current review schedules, we would anticipate completing our review by August 31,1999. This date could change depending on the findings or our technical review, urgent assignments, or other factors. We will promptly communicate any significant changes to this schedule.
