5 MM. CHILK: The first document before the Commission, 6 Mr. Chairman, is SECY-83-367A. It is Public Service Company of 7 new Mexico's Proposed Sale and Leaseback Transaction for 8 Mefinancing Its Interest in Palo Verde 1.

9 The Commission here is being asked to respond to a 10 request by the Arizona Public Service Company to approve a 11 sale and a leaseback financing transaction in conjunction with

( 12 the Palo Verde Nuclear Generating Station Unit Number 1.

13 All Commissioners have approved the order which 14 approves a proposed financial transaction with a licensee 15 amendment recommended by the stati and subject to the 16 conditions that were included in the order which is attached 17 to the paper.

20 MR. CHILK: The second one is85-371, a request for 21 refund of Black Fox license fees where the Commission is being 22 asked to act on a petition from the co-owners, the Public 23 Service Company of Oklahoma, the Associated Electric 24 Cooperative, Inc. and Western Farmers Electric Cooperative 25 that requests the Commission to reconsider the NRC stati

, 4 1 decision which denies an exemption for the payment of license 2 fees.

3 All Commissioners have approved the order which 4 denies the requested fee exemption. The order further notes 5 that NHC has turnished pertinent information which would allow 6 the petitioners to determine whether NRC erroneously calculated 7 its tee and 11 so and the statt is advised and later determines 8 that the fee charged was erroneous a,retund will be provided.
