This is an affirmation and discussion session and I ask 5
the secretary to lead us through it.

Mr. Chairman, the Commission will 7
have to.take a vote to hold both of these affirmations, i
8 SECY-86-31 and the affirmation of an order on Shoreham, to

vote to hold on less than one week's notice.
I wonder if I 10 could have it.

The first paper is 86-31.'
It is a 14 request for reconsideration of the TMI-2 Leak Rate Proceeding J
t 15 Notica of Hearing.
In this, the Commission is being asked to 16 act on a motion filed on behalf of former employees of i
f 17 Metropolitan Edison Company requesting the Commission modify 18 its December 18, 1985 Notice of Hearing which set forth the i
19 grounds for that hearing.
I 20 Chairman Palladino, Commissioners Roberts, Bernthal I
i 81 and Zech have approved the order which denies the motion.
22 Commissioner Asselstine has disapproved the order.

1 and order in the Shoreham Nuclear Power Station.
In this 2
memorandum and order the County of Suffolk, State of New York

3 and the town of South Hampton seek a ' Commission order pursuant 4
to 10 CFR,27.40 compelling the staff and LILCO and FEMA to 5
produce certain documents.

The' order which is before you r?'*es that the 7
request conflicts with the provision of 10 CFR 2.740 and 8
is hereby rejected.
9 Commissioner Roberts, Bernthal and Zech have 10 approved the order.
Commissioner Asselstine has abstained.
11 Chairman Palladino is not participating.
12 Would you please affirm your votes?

I would note on that last 15 one that ordinarily I would not participate but in order to q
16 constitute a quorum so that the will of the majority could 17 prevail, I was willing to abstain.
