1 p ROCEED 1 N GS 2 CHAIRMAN PALLADIND: This is an 3 affirmation / discussion session. We have two items listed on 4 the agenda. I am going to ask the Secretary to lead us 5 through those two items.

6 in addition, we have another item that we'd like to 7 put on with short notice, and after we have discussed the 8 first two items, I will have the Secretary lead us through 9 that item.

10 MR. CHILK: The first item, Mr. Chairman, is SECY 11 85-169. It's the Director's Denial of 2.206 petition in the 12 matter of Consumers power. In this paper the Commission was 13 asked to approve an order which affirmed the decision of the 14 Director of ISE who denied a 2.206 petition by Billie Garde 15 related to the construction of the Midland Nuclear power 16 plant.

17 All Commissioners have approved the order. Would 18 you please affirm your orders.

20 MR. CHILK: The second item is 85-60, entitled Final 21 pressurized Thermal Shock Rule. The Commission here is being 22 asked to approve a final rule on pressurized thermal shock.

23 Again, all Commissioners have approved the rule.

24 Commissioner Asselstine has provided additional views to be 25 published with the rederal Register notice. Commissioner

3 1 Roberts has proposed a modification which was not agreed to.

l 2 Would you please affirm your votes?

3 COMMISSIONER ASSELSTINE: There is one item on that 4 one -- I am not asking that we hold up this rule, but I note 5 that Mr. Udall has sent us a letter that bears on this issue, 6 asking us to set up an advisory group on it to look at one 7 aspect of the issue. I think wa ought to act on that fairly O soon, if we can, because it's at least related to the rule, 9 although I am not asking that we hold up the rule at this 10 point.

11 MR. CHILK: We will take that matter and handle it 12 accordingly.

13 Will the Commission please affirm its votes, all 14 agreeing to the proposal?

16 MR. CHILK: The third itom is an order on Shoreham, 17 and before we can take the matter up, the Commission will have 18 to vote to handle it on short notice.

CHILK: The order the Commission is being asked 21 to approve here is identical to the order that was recently 22 approved, with one exception, and that is the order on pages 6 23 and 7, containing now the views of the majority addressing 24 Commissioner Asselstine's disapproval of the matter, and the 25 order also contains a deletion of several words as suggested

O 1 by Commissioner Zech on page 7.

2 It is my understanding that all of you have approved 3 -- agreed with this order as it is now presented, and I would 4 ask you to affirm your votes.

2 5 CHAIRMAN pALLADINO: Before we affirm the vote, in 6 affirming this vote, this is not to be precedent-setting, 7 inasmuch as it's not clear whether or not we are required to 8 do it, and to be on the safe side i suggest we reaffirm it and 9 ask as a separate matter that 03C give us a definitive paper 10 on whether this kind of thing needs to be reaffirmed in the 11 future.

12 Were there other comments? All right, are you ready 1,3 for us to affirm our vote?

14 MR. CHILK: Yes. If you are ready to affirm your 15 votes, four of you in favor of it, Commissioner Asslestine 16 disapproving. Would you affirm your votes?
