FRED A. METTLER, JR., M.D., being duly sworn, deposes and says as follows:

1.- I am Vice Chairman, Department of Radiology, University of New Mexico Hospital. I am also Chief, Radiology Service at Albuquerque Veterans Administration Medical Center. My business addresses are University of New Mexico Hospital,' Lomas Boulevard, Albuquerque, New Mexico 87131 and Albuquerque Veterans Administration Medical . Center, 2100 Ridgecrest Drive S.E., Albuquerque, New Mexico 87108 respectively. I have personal knowledge of the matters stated herein and believe them to be true and correct. I make this affidavit in support of Applicants' .40 tion for Summary Disposition of Eddleman Contention 57-C-7 in this proceeding.

2. I am currently a Professor in the Department of Radiology at the University of -

New Mexico School of Medicine where I have been employed since 1977. I am also -

Director of the Radiology Fellowship Program at the University Hospital. I serve on several committees including the American College of Radiology, the American College 85010{0126850102 DRAOCK05000go

of ' Nuclear Physicians, and the National Council on Radiation Protection and Measurements. In addition,I work with the United Nations Scientific Committee on the Effects of Atomic Radiation (UNSCEAR) as a member and consultant. A summary of  !

my professional qualifications and experience is attached hereto as Attachment 1.

3. Contention 57-C-7 states in relevant part:

Neither the State ERP nor the county ones make clear whether the hospitals listed in Section V.B.3. of the State ERP are prepared to treat severe radiation exposure per se.  ;

4. Part 1,Section V.B.3 of the North Carolina Emergency Response Plan (ERP) lists the following hospitals as ones that will support the Shearon Harris Nuclear Power l

. Plant and the surrounding communities in the event of a radiological emergency:

Duke University Medical Center, Durham, North Carolina Wake County Medical Center, Raleigh, North Carolina Central Carolina Hospital, Sanford, North Carolina Raleigh Community Hospital, Raleigh, North Carolina

Rex Hospital, Raleif t, North Carolina North Carolina MemorialIlospital, Chapel Hill, North Carolina Good Hope Hospital,Inc., Erwin, North Carolina Chatham Memorial Hospital, Siler City, North Carolina

-5.' In my opinion accidents that involve external radiation exposure (irradiation) that may be classified as " severe" on a medical basis are those in which there has been exposure in excess of 100 rems of penetrating whole body radiation.

6. Treatment of persons. receiving such exposures varies depending upon the magnitude of the absorbed dose as well as the amount of time since the exposure took place.
7. In the first several days after exposure, the treatment is the same whether the patient has received 100 rems or an acute lethal exposure. All of the hospitals that are

, . listed in the ERP are capable of treating such patients at least for the first 48 hours5.555556e-4 days <br />0.0133 hours <br />7.936508e-5 weeks <br />1.8264e-5 months <br /> after exposure.

8. Some cases of whole body severe radiation exposure involve substantial cellular damage. In those cases the treatment is not unique to radiation exposure accidents.

l Treatment of these conditions occurs rather routinely at hospitals which treat patients' l malignancies either with radiation therapy or chemotherapy.

9. I have personally contacted all of those hospitals listed in the North Carolina .:

ERP. The hospitals that have the capability and expertise to treat even the most severe cases of whole body radiation exposure are Duke University Medical Center, Rex Hospital and North Carolina Memorial Hospital.

10. Localized severe exposures, as opposed to whole body exposures, may also be initially treated at any of the hospitals listed in the ERP. Again, where more severe exposures cause cellular damage, Duke University Medical Center, Rex Hospital, and North Carolina Memorial Hospital all three have the necessary capabilities to treat such cases.
11. In conclusion, on a medical basis I consider severe radiation exposure to occur where there has been exposure in excess of 100 rems of penetrating whole body radiation. I have personally contacted each of the hospitals listed in the State ERP and all of those hospitals are capable of treating such exposure cases for the first 48 hours5.555556e-4 days <br />0.0133 hours <br />7.936508e-5 weeks <br />1.8264e-5 months <br />.

In some such severe radiation exposure cases, substantial cellular damage occurs. The treatment for these conditions occurs routinely at - hospitals which treat patients' malignancies either with radiation therapy or chemotherapy. Accordingly, Duke University Medical Center, Rex Hospital, and North Carolina Memorial Hospital have the capabilities and expertise to treat such cases. For localized severe exposures, all i hospitals listed in the ERP are capable of initial treatment, while Duke University Medical Center, Rex Hospital, and North Carolina Memorial are capable of treating even the most severe cases.
