(Shearon Harris Nuclear Power Plant) ) ASLBP No. 99-762-02-LA ORANGE COUNTY'S MOTION FOR EXTENSION OF DISCOVERY DEADLINE Pursuant to the Licensing Board's Memorar.dum and Order (Granting Request to Invoke 10 C.F.R. Part 2, Subpart K Procedures and Establishing Schedule) (July 23, 1999), Orange County hereby requests an extension of the October 31,1999, deadline for concluding discovery in this proceeding. The extension is needed to permit Orange County to take depositions of two CP&L witnesses and an NRC Staff witness regarding criticality issues on November 2 and 4,1999.

Counsel for all parties have proceeded diligently and cooperatively in the taking ofdiscovery, and the parties have consulted extensively to come up with a workable deposition schedule within the Board's time frame. Of the 13 depositions to be taken in  ;

1 1 the proceeding, counsel for the parties were able to schedule all but two before tiie end of October. Two depositions are scheduled in Washington, D.C. on October 15 and 18; five depositions are scheduled in North Carolina for November 19 through 21; and three l

to schedule depositions v all of the experts by the end of the month. Therefore, a brief extension of the discovery schedule is requested.' The requested extension will have no effect on the schedule for Subpart K presentations or oral argument. j l
