ALVIN H. JOYNER, being duly sworn, deposes and says:

I am the Lead Planner for Fixed Nuclear Facilities for the North Carolina Deparffent of Crime Control and Public Safety, Division of Emergency Management

("DEM"). The basic responsibilities of DEM include fulfilling the State's role in emergency planning for natural and manmade disasters, in responding to and recovering from disasters, and in mitigation of their effects. As a primary planner for fixed nuclear facilities, I have been directly involved in the development of the offsite emergency capability for the Shearon Harris Nuclear Power Plant, as well as the Catawba. McGuire, and Brunswick nuclear plants. Since April,1985, I have had overall responsibility for emergency planning activities concerning the Harris plant. I was also responsible for overall coordination with the affected counties and the ut!11ty in the development of the May 1986 exercise for Shearon Harris. A current statement of my professional i

qualifications and experience is attached hereto. My business address is 116 West Jones Street, Raleigh, North Carolina 27601. I have personal knowledge of the matters stated herein and believe them to be true and correct. I make this affidavit in response to Eddleman Contention EPX-8.

2.

An exercise of the North Carolina Emergency Response Plan ("ERP") In Support of th6 Shearon Harris Nuclear Power Plant was held on May 17 and 18,1985.

This was the first fut scale exercise of the off-site response capability for the Harris Plant. The exercise was very beneficial to all of the agencies involved, for it demonstrated that basic, overall response capability was very good, while suggesting areas for improvement.

The exercise scenario postulated that, on Saturday, May 18,1985, plant conditions and county response capab!11tles were such that the State was requested to assume overall direction and control of emergency response. The State did assume control of the response and, in that capacity, directed activation of the Emergency Broadcast System ("EBS") and simulated preparation of EBS messages. On Saturday, there wergtwo simulated activations of the EBS.

The EBS activation steps used on Saturday were conducted correctly and proceeded smoothly. The initial EBS message was simulated for broadcast in a timely l

fashion, and no communication problems were encountered. Nevertheless, the expertence with the EBS on Saturday Indicated the need for certain changes in DEM's i

EBS procedures -- specifically, to improve the use of the prescripted EBS messages to

assure that they are released on a continuing basis after the initial etivation so the public is properly informed throughout the emergency.

Draft EBS messages are included in the ERP. These draft messages are intended to facilitate the preparation of EBS messages in an emergency, by providing l

several standardized paragraphs covering the !!kely range of plant conditions and protective action instructions. In an emergency, the preparer selects the appropriate paragraphs, completes the blanks in the paragraphs with situation-specific information (such as planning zones to be evacuated), and assembles the paragraphs into a complete message. Draft messages, suitable for both the initial and subsequent broadcast over the EB8, are available.

The simulated EBS messagu prepared by the State during the exercise did not identify locations where evacuees without access to vehicles could obtain transportation, although it was indicated that pick-up points would be broadcast in a subsequent EBS message. While there is a separate draft message which would have provided this information, the preparation and release of that subsequent message was not simulated in the exercise. To assure that this information about transportation assistance is not omitted from the broadcast EBS messages in the event of an actual emergency, the steps used to process EBS messages will be revised by an expansion of the public education and Information sections (Parts 1 to 5) of the ERP and related implementing procedures.

This expangn will require the State's and Counties' Public Information Officers (" PIOS")

to assure timely preparation and broadcast of the EBS messages used subsequently to the initial message. These subsequent messages Include that used to instruct the publ;c on the location of pickup points. The PIOS will be required to prepare and provide these messages to the SERT Director after an initial EBS broadcast instructing the public to evacuate. These revisions will be completed pr!or to full power licensing of the plant.

7. Similarly, the State did not simulate the preparation of " follow-up" EBS messages during the exercise; this is the " incompleteness In coverage" to which the FEMA exercise report referred. To assure the preparation of " follow-up" EBS messages in an actuel emergency, the requirements placed on the PIOS noted in paragraph 6 will

Include a step for the PIO to assure there is a continuing release of information to the EBS lead program control station until the protective action for the public is completed, e.g., until evacuation is complete. This revision to the P!O's procedures will be completed prior to full power licensing of the plant.

8. Finally, with the support of Applicants, DEM is taking steps to accomplish the replacement of the telephone conferenclng system used for EBS netivation during the exercise, by the provision of new telephones and lines on the state's 733 exchange and related equipment to the Wake County EOC, the Wake County s!ren activation point, and the state EOC. The state warning point is already on the 733 exchange. Separate, reserved lines will be provided to the other county EOCs, to the plant, and to the lead EBS station (Lee, Chatham, and Harnett Countles, the plant, and the EBS station do not Initiate calls, so the 733 exchange is not needed there). (This modifies the Information in paragraph 9 of the Affidavit of Russell Capps on Eddleman EPX-8). Installation of all equipmert for the new, dedicated telephone conferencing system, and training on the new equipment and associated procedure revisions, will be completed prior to full power licensing olthe Harris plant. The training program will include all county emergency response coordinators, designated alternate representattves, the lead EBS program control station, appropelate SERT representatives and others. Special efforts will be made to provide training to the Wake County EOC personnel, for Wake County serves as the coordinating county for EBS activation. The training program will include instruction on the proper method to add parties to the conference network without breaking the network.
9. In addition, DEM is expanding its ongoing program of " table top" exercises to include practice in EBS activation whenever possible. The training program for operation of the new telephone conferencing system, noted in Paragraph 8, will include instruction I

In establishing the communication link with the lead EBS program control station as well as the preparation of initial and followup EBS messages. Furthermore, at least one table top EBS exercise will be conducted prior to each scheduled fixed nuclear facility exercise if the EBS procedures have not been used in the past 24 months.

10. In conclusion, the concerns about EBS activation during the exercise have been analyzed, and the basis for the problems is understood. Corrective actions have been identified, and are being implemented. All will be completed prior to full power licensing of the plant. I am confident that these corrective actions will prevent the recurrence of the problems experienced during the exercise of May 17-18, 1985.
