DAYNE H. BROWN, being duly sworn, deposes and says as follows:

1. My name is Dayne H. Brown. I am employed as Chief of the Radiation Protection Section (RPS), Division of Facilities Services, North Carolina Department of Human Resources. ' My business address is Post Office Box 12200, Raleigh, North IE- Carolina 27605. I have served in my present position as Chief of RPS since June 1967. I received a Bachelor'of Science degree (with honors) in Physics in 1962 from North Carolina State University. In 1964, I also received a Master of Science degree in Physics from N. C. State. A copy of my Curriculum Vitae, which contains additionalinformation about my education and professional background, is attached to this Affidavit as Attachment 1.
2. As Chief of RPS, I have overall responsibility for coordinating RPS's activities

- in the event of an accident at the Harris Plant. Responsibilities of the RPS are set forth in the North Carolina Emergency Response Plan at Part 1,Section III.D.I. and include 1; g

identifying medical-facilities to treat suspected or actual radiation contaminated victims, developing medical response plans for off-site consequences of nuclear emergencies, developing a system for follow-up of individuals exposed to radiation, and .

maintaining a list of qualified medical consultants who can, assist state and local medical authorities.

3. Contention 57-C-7 states in relevant part:

4. One facility that provides specialized radiation treatment and radiation 4

consultation assistance on a 24 hour-a-day basis is the Oak Ridge Radiation Emergency Assistance Center / Training Site (REAC/TS) in Oak Ridge, Tennessee, a U.S. Department of Energy facility. REAC/TS and other federal assistance are available to aid the State and local authorities and utilities through the Federal Radiologicril Emergency Response Plan (FRERP). The State may request that these services and facilities be made available through either the Federal Emergency Management Agency (FEMA) or the Nuclear Regulatory Commission. In the event of an emergency at the Harris Plant, the RRS is prepared to call on REAC/TS as necessary to provide expert medical consultation i

for attending physicians and to provide facilities to which patients may be transported for state-of-the-art care and treatment.

5. Because the nature of radiation injury is such that it unfolds over a period of time, it is reasonablu to provide for initial diagnosis and treatment at local facilities with consultation and possible subsequent relocation to a definitive care facility such as i REAC/TS as necessary.

Accordingly, the REAC/TS facility at Oak Ridge may be considered an additional regional facility for treating cases of severe radiation exposure per se, supplementing those listed in the NC ERP.
