Dear Judge. Miller:

In an Order dated November 17, 1983 the Atomic Safety and Licensing Board granted the State of Delaware's petition for leave to intervene in proceedings on the proposed issuance of an amendment to the. Operating License for Salem Nuclear Generating Station, Unit 1. The Nuclear Regulatory Commission's Safety Evaluation found that the amendment extending the time period for perforitance of a Type A test did not involve'a significant hazards consideration and therefore the amendment issued.

Delaware was given until January 4, 1984 to file a supple-ment to its intervention petition setting forth at least one cognizable contention in compliance with 10 C.F.R. 52.714 (b) . A two-week extension was requested while technical experts completed a review of the matter. On the advice of the technical staff which has now concluded its review, Delaware has determined that no contention will be filed.

While our concern regarding the safe operation of the Salem Nuclear Generating Station continues, the petition opposing

, the particular license amendment extending the Type A test inter-val on a-.one-time basis is hereby withdrawn.
