CALABRESE SECRETARY The Board of Public Utilities of the State of New Jersey is currently conducting an investigation into the causes of the extension of the 1979 Outage of Salem Nuclear Generating Station* No.* I.
The* 'purpose :of this letter is to request the testimony of ~r. William T. Russell, formerly Chief of the *Techriica'l Support Branch 'in the Off ice of Nuclear Reactor Regulation, on the *work required of and done by the licensee of Salem I under the *:r & E bulletins issued, revised or supplemented by the Nuclear Regulatory Commission and affecting the duration of the *outage.~ Although the Board would not sponsc:$r Mr. Russell's appearance, it is our opinion that his non-partisan testimony would help to assure the creation of a full and complete record.
A review of Mr. Russell's testimony in other stat~::;
demonstrates that he can add substantially.to the eyiderice in the.record of the proceeding*before the New Jersey Board of Public Utilities.
The transcripts of Mr. Russell's testimony and cross-examination in jurisdictions outside *of New Jersey, however, cannot directly and simply be made a part of the record in New Jersey.
Under New Jersey law, the parties to the proceeding must be afforded the opportunity of cross-examination.
The petitioner, Public Service Electric and Gas Company, is unwilling to relinquish or waive the right.

20555 page 2 The proceedings on the Salem I outage, already held before the Maryland Public Service Commission, required two appearances of Mr. Russell.
We recognize the demands upon his schedule and hope to keep his involvement' in the New Jersey proceeding to* a minimum.
We believe that this cross-examination in New Jersey, unlike that in Maryland, can be limited to one day by a distribution of the relevant materials to the parties in advance of his appearance.
The Administrative Law Judge and the parties to the proceeding have set aside for the*
appearance the day of December 8, which date was already mentioned to Mr. Russell.
We look forward to your prompt consideration in order to enable us to make the appropriate preparations and to enable us to distribute timely the *materials relevant to Mr. Russell's cross-examination.
