(Point Beach Nuclear Plant Unit 1) ) PETITIONER'S ALTERNATIVE MOTION FOR AN CRCER CERTIFYING A" QUESTION TO MIE COMMISSION CR PEPMITTING INTERIDCUTCRY APPEAL CF A BOARD DECISION, IN THE EVENT THE BOARD CENIES PETITIONER'S REQUEST FCR A HEARING Petitioner Wisconsin's Environmental Decade, Inc. (" Decade") , hereby moves the Board in the alternative, pursuant to the Rules of Practice, 10 C .F .R . 2. 718 (i), 2.730 and 2.785, in the event the Board determines to deny the Decade's request for hearing on the steam generator tube degradation safety problem, for an order certifying to the full Commission the question of whether the decision in Public Service Comcany of Indiana (Marble Hills Nuclear Generating Station, Units 1 and 2) , CLI 80-10(March 13,1980) should not be precedent for this case or shou'id be rejected and not applied to this cases or, in the further altsrnative, in the event the Board also denies the request for certification of a question, for an order permitting the Decade to file with the full Commission an interlocutory appeal of the Board's decision denying the request for hearing. The grounds upon which the instant alternative motion is based include the following: l_. The Order of the full Cb= mission establishing this Board was entered with only a three-to-two majority of the Commission existing at that times 2_. The Order of the Co= mission in the aforesaid Marble Hills decision was also entered with only a two-to-one majority of the Commission existing at that timer gp48f6@uA

3,. Subsequent to entry of the Order establishing this Board and the , aforesaid Marble Hills decision, the make-up of the Commission has changed in that the term of one mmmissioner in the majority has expired and a new Chairman has been named.

     ,4_. Two of the present Commissioners have recently expressed serious objection to the soundness of the Marble Hill decision at the time it was entered and the subsequent " levels of illusion involved in the Nuclear Regulatory Commission's application" of the Marble Hill decision. In addition,'these two Consissioners have stated that the hearing offer under the Marble Hills test is a " transparent sham" and that the "NRC's priority on citizen inwivement is, as is stated expressly on page 6 of the Marble Hill opinion, a relatively low one". (Footnote omitted.)
