NRC STAFF REQUEST FOR CLARIFICATION On May 26, 1982, the Atomic Safety and Licensing Board (Board) issued a Memorandum cnd Order (Concerning a Motion to Release to the Public Certain Safety Information Which Ts Part of the Record in this Case But is .

' discussed below, the NRC Staff hereby seeks clarification of, Paragraph 7'of the Order contained in the Board's Memorandum and Order of May 26, 1982, because that paragraph could be interpreted as suspending the. application .if - .

.,, the Freedom of Information Act (F0IA) to enumerated Westinghouse proprietary information for a period of two years.

The disposition af F0IA requests by the NRC mi,'st be made in accordance with applicable statutory, judicial and regulatory precedent. The F0IA, itself, the judicial decisions reflecting proper agency administration of the Act and the NRC's regulations and procedures -- 10 C.F.P,. Part 9 and NRC Appendix 0211 -- do not have any provisions for the suspension of the disclosure requirements of the F0IA for a period of two years.   • authorities require that,the agency make a determitiation within 10 days whether the information subject to the request should be released to the requester or withheld pursuant to nine narrowly applied exemptions. Of course the agency is free during this determination period to. review, evaluate and apply any available administrative record vis-a-vis the subject determination, but we are required to make an independent judgment as to t

whether such information may be legally withheld.

Commission's obligations under the Freedom of Information Act for two years i as to the covered information, and the last two sentences as a limitation on the statutory requirements and judicial precedent that apply to F0IA requests. We do not believe this was the Board's intent. A'ccordingly, the

, NRC Staff requests the Board to clarify the meaning and effect that the' Board wishes tc achieve by Paragraph 7 of its Memorandum and Orde~r o'f May 26, 1982.
