By letter dated August 26, 1985, as supplemented October 8, 1985, Wisconsin Electric Power Company ("WEPC0") requests that the Commission grant an extension from the November 30, 1985 deadline for environmental qualification of electrical equipment at Point Beach Nuclear Plant, Units 1 and 2. The request covers one item of equipment for which an extension is sought from August 31, 1985, the date of the last extension granted by the NRC staff, until December 31, 1985, for Unit 2 and until the spring 1986 plant outage for Unit 1. The Comission has reviewed in detail the licensee's. submittal and the staff's analysis and recommendation as set forth in SECY-85-330. Based on this review the Commission finds that the licensee has demonstrated the exceptional nature of its case such that extensions for both units will be granted.

9 i: 2 The Comission most recently addressed the environmental qualifica-tion issue in Generic Letter 85-15, issued August 6, 1985. In that ,

letter the Comission stated that extensions from the November 30

. deadline established in 10 CFR 50.49(g) would be granted "only in rare circumstances." The Comission further stated that extension requests "must clearly identify the exceptional nature of the case, e.g., why, through events entirely beyond its control, the licensee will not be in compliance on November 30; the date when compliance will be achieved; and a justification for continued operation until compliance will be achieved." -The Comission also set forth an enforcement policy regarding failure to meet the deadline.

This licensee's good faith efforts to meet the deadline are clear.

Only one item (two Crosby Lift Indicating Switch Assemblies for each unit) remains to be qualified. As to this item, the record establishes that WEPC0 purchased the equipment in 1981 with the understanding that it would be environmentally qualified within the near future by the manufacturer. However, the manufacturer's testing program was not completed until September 1985, a circumstance beyond the licensee's control. The qualified equipment, which is most safely and efficiently installed while the plant is not in operation, will be placed in Point Beach Unit 2 during a current refueling outage scheduled to end on November 22, 1985. Because of the late conclusion to the manufacturer's testing program, however, the plant specific documentation needed to bring that- unit into full compliance with the requirements of 10 CFR 5 50.49 cannot be completed before December 1985. As to Unit 1, the licensee has comitted to installation of the qualified equipment during

i 3 the next scheduled refueling outage in the spring of 1986. Under the circumstances, the Comission concludes that an extension of the November 30 deadline is appropriate.

The Comission therefore grants the request of WEPC0 for an exten-sion on Point Beach Units 1 and 2. The staff has reviewed the justification for continued operation and finds that it supports safe operation of Unit 2 until December 31, 1985, and of Unit 1 until the spring 1986 refueling outage. The deadline for equipment qualification for Unit 2 is hereby extended from August 31, 1985, until December 31, 1985, and for Unit 1 from August 31, 1985, until the spring 1986 outage for that unit, but no later than May 25, 1986.
