The U.S. Nuclear Regulatory Commission has issued the enclosed Amendment No. 227.to Renewed Facility Operating License No. DPR-42 and Amendment No. 215 to Renewed Facility Operating License No. DPR-60 for the Prairie Island Nuclear Generating Plant, Units 1 and 2, respectively.
The amendments consist of changes to the technical specifications (TSs) in response to your application dated June 26, 2018. The amendments revise TS 1.3, " Completion Times" Example 1.3-3, TS 3.6.5, "Containment Spray and Cooling Systems," TS 3.7.5, "Auxiliary Feedwater (AFW) System," TS 3.7.8, "Cooling Water (CL) System," TS 3.8.1, "AC Sources -Operating," and TS 3.8.9, "Distribution Systems -Operating" by eliminating the second completion time in accordance with Technical Specifications Task Force (TSTF)-439, Revision 2, "Eliminate Second Completion Times Limiting Time from Discovery of Failure to Meet an LCO [limiting condition for operation]." A copy of our related safety evaluation is also enclosed.

NSPM shall operate the facility in accordance with the Technical Specifications.
- 3. This license amendment is effective as of the date of its issuance and shall be implemented within 90 days.

C. This renewed operating license shall be deemed to contain and is subject to the conditions specified in the following Commission regulations in 10 CFR Chapter I: Part 20, Section 30.34 of Part 30, Sections 50.54 and 50.59 of Part 50, and Section 70.32 of Part 70; is subject to all applicable provisions of the Act and to the rules, regulations, and orders of the Commission now or hereafter in effect; and is subject to the additional conditions specified or incorporated below: (1) Maximum Power Level NSPM is authorized to operate the facility at steady state reactor core power levels not in excess of 1677 megawatts thermal. (2) Technical Specifications The Technical Specifications contained in Appendix A, as revised through Amendment No. 227, are hereby incorporated in the renewed operating license. NSPM shall operate the facility in accordance with the Technical Specifications.
(3) Physical Protection NSPM shall fully implement and maintain in effect all provisions of the Commission-approved physical security, guard training and qualification, and safeguards contingency plans including amendments made pursuant to provisions of the Miscellaneous Amendments and Search Requirements revisions to 10 CFR 73.55 (51 FR 27817 and 27822) and to the authority of 10 CFR 50.90 and 10 CFR 50.54(p). Completion Times for Condition A and Condition B are tracked separately for each train starting from the time each train was declared inoperable and the Condition was entered. A separate Completion Time is established for Condition C and tracked from the time the second train was declared inoperable (i.e., the time the situation described in Condition C was discovered).
If Required Action C.2 is completed within the specified Completion Time, Conditions Band Care exited. If the Completion Time for Required Action A.1 has not expired, operation may continue in accordance with Condition A. The remaining Completion Time in Condition A is measured from the time the affected train was declared inoperable (i.e., initial entry into Condition A). It is possible to alternate between Conditions A, B, and C in such a manner that operation could continue indefinitely without ever restoring systems to meet the LCO. However, doing so would be inconsistent with the basis of the Completion Times. Therefore, there shall be administrative controls to limit the maximum time allowed for any combination of Conditions that result in a single contiguous occurrence of failing to meet the LCO. These administrative controls shall ensure that the Completion Times for those Conditions are not inappropriately extended.

The Note allows Condition A to be entered separately for each inoperable valve, and Completion Times tracked on a per valve basis. When a valve is declared inoperable, Condition A is entered and its Completion Time starts. If subsequent valves are declared inoperable, Condition A is entered for each valve and separate Completion Times start and are tracked for each valve. If the Completion Time associated with a valve in Condition A expires, Condition B is entered for that valve. If the Completion Times associated with subsequent valves in Condition A expire, ~ondition B is entered separately for each valve and separate Completion Times start and are tracked for each valve. If a valve that caused entry into Condition B is restored to OPERABLE status, Condition B is exited for that valve. 2.0 REGULATORY EVALUATION
- 2. 1 System Description 2.1.1 Completion Times The completion time (CT) is the amount of time allowed for completing a required action. It is referenced to the time of discovery of a situation (e.g., inoperable equipment or variable not within limits) that requires entering an action condition unless otherwise specified, provided the unit is in a mode or specified condition stated in the applicability of the LCO. Required actions must be completed prior to the expiration of the specified CT. An action condition remains in effect and the required actions apply until the condition no longer exists or the unit is not within the LCO applicability.
Enclosure 3 The description section of the licensee's TS 1.3 , CT, states that once a condition has been entered, subsequent trains, subsystems, components or variables expressed in the condition, discovered to be inoperable or not within limits, will not result in separate entry into the condition, unless specifically stated. The required actions of the condition continue to apply to each additional failure, with CTs based on initial entry into the condition. Additional secondary CTs, such as limits on the period of time from discovery of the failure to meet the LCOs discussed above, were specified to prevent repeated entry and exit from alternating TS required actions. 2.1.2 Containment Spray and Cooling System The containment spray and containment cooling systems provide containment atmosphere cooling to limit post-accident pressure and temperature in containment to less than the design values. Reduction of containment pressure and the iodine removal capability of the spray reduces the release of fission product radioactivity from containment to the environment, in the event of a design basis accident (DBA), to within limits. PINGP's TS LCO 3.6.5, " Containment Spray and Cooling Systems," required actions A.1 , C.1 , and D.2, have a second CT of 10 days from discovery of failure to meet the LCO. 2.1.3 Auxiliary Feedwater System The AFW system automatically supplies feedwater to the steam generators to remove decay heat from the reactor coolant system upon the loss of normal feedwater supply. The CL system provides a heat sink for the removal of process and operating heat from safety-related components during a DBA or transient.
During normal operation, and a normal shutdown, the CL system also provides this function for various safety-related and nonsafety-related components. The safety-related function is covered by PINGP's TS LCO 3.7.8. Also, the licensee proposed to delete the following statement from PING P's TS 1.3: The Completion Times of Conditions A and 8 are modified by a logical connector, with a separate 10-day Completion measured from the time it was discovered the LCO was not met. In this example, without the separate Completion Time, it would be possible to alternate between Conditions A, 8 and C in such a manner that operation could continue indefinitely without ever restoring systems to meet the LCO. The separate Completion Time modified by the phrase "from discovery of failure to meet the LCO" is designed to prevent indefinite continued operation while not meeting the LCO. This Completion Time allows for an exception to the normal "time zero" for beginning the Completion Time "clock." In this instance, the Completion Time "time zero" is specified as commencing at the time the LCO was initially not met, instead of at the time the associated Condition was entered. The licensee proposed to replace the paragraph above with the following statement:
It is possible to alternate between Conditions A, 8, and C in such a manner that operation could continue indefinitely without ever restoring systems to meet the LCO. However, doing so would be inconsistent with the basis of the Completion Times. Therefore, there shall be administrative controls to limit the maximum time allowed for any combination of Conditions that result in a single contiguous occurrence of failing to meet the LCO. These administrative controls shall en i ure-that the Completion Times for those Conditions are'" hot 1nappropriately extended.
The licensee's proposed change also deletes the second CT associated with the following TS LCOs required actions:
- TS 3.6.5, "Containment Spray and Cooling Systems," required actions A.1, C.1, and 0.2
- TS 3.7.5, "Auxiliary Feedwater (AFW) System," required actions A.1 and 8.1
- TS 3.7.8, "Cooling Water (CL) System," required actions A.1, 8.3, and 0.1
- TS 3.8.9, "Distribution
- Systems-Operating," required actions A.1 , B.1, and C.1 2.3 Regulatory Requirements and Guidance Documents The U.S. Nuclear Regulatory Commission (NRC) staff reviewed the proposed changes to eliminate TS second CTs against the criteria in Title 10 of the Code of Federal Regulations (10 CFR) Section 50.36 and the precedent established in NUREG-1431, "Standard Technical Specifications
[STS], Westinghouse Plants," Revision 4. Section 182a of the Atomic Energy Act requires applicants for nuclear power plant operating licenses to include TS as part of the license. These TS are derived from the plant safety analyses. In 10 CFR 50.36, the NRC established its regulatory requirements related to the content of the TS, which include: (1) safety limits, limiting safety systems settings and control settings, (2) LCOs, (3) surveillance requirements , (4) design features, and (5) administrative controls. In NUREG-1431, a second CT (henceforth referred to as "second CT") was included in the STS for certain required actions to establish a limit on the maximum time allowed for any combination of conditions that would result in a single continuous failure to meet the LCO. These CTs are joined by an "AND" logical connector to the condition-specific CT and state " X days from discovery of failure to meet the LCO" (where "X" varies by spec i fication).
The intent of the second CT was to preclude entry into and out of the actions for an indefinite period of time without meeting the LCO. The second CT provides a limit on the amount of time the LCO would not be met for various combinations of conditions. TSTF-439, Revision 2, deletes these second CTs from the affected STS required actions. In regulation 10 CFR 50.65 , "Requirements for Monitoring the Effectiveness of Maintenance at Nuclear Power Plants" and specifically , 10 CFR 50.65(a}(1 ), requires each licensee to monitor the performance or condition of structures, systems, and components (SSCs) against licenseeestablished goals in a manner sufficient to provide reasonable assurance that the SSCs are capable of fulfilling their intended functions.
These goals shall be established commensurate with safety and, where practical, take into account industrywide operating experience.
When the performance or condition of a SSC does not meet established goals, appropriate corrective action shall be taken. The effectiveness of these performance and condition monitoring activities, and associated goals and preventive maintenance activities, are evaluated at least every refueling cycle, not to exceed 24 months, per 10 CFR 50.65(a)(3).
The goals shall be established "fr ommensurate w if h safety and, where practical, take int o account industr y-wide operating experience.
By letter dated June 20 , 2005 (ADAMS Accession No. ML051860296), the TSTF submitted a proposed change, TSTF-439 , Revision 2, to the improved STS. The proposed TSTF-439, Revision 2 , was approved by the NRC in a letter dated January 11, 2006 (ADAMS Accession No. ML060120272).
3.0 TECHNICAL EVALUATION The license amendment request (LAR) stated the following regarding the 10 CFR 50.65, referred to as the Maintenance Rule (MR): Under 10 CFR 50.65(a)(4), the risk impact of all inoperable risk-significant equipment is assessed and managed when performing preventative or corrective maintenance.
Risk assessments at PINGP are conducted using the procedures and guidance endorsed by Regulatory Guide 1.160 , "Monitoring the Effectiveness of Maintenance at Nuclear Power Plants". Regulatory Guide 1.160 endorses the guidance in Section 11 of NUMARC 93-01, "Industry Guideline for Monitoring the Effectiveness of Maintenance at Nuclear Power Plants." These documents address general guidance for conduct of the risk assessment, quantitative and qualitative guidelines for establishing risk management actions, and example risk management actions. These include actions to:
- plan and conduct other activities in a manner that controls overall risk,
- increase risk awareness by shift and management personnel ,
- reduce the duration of the condition,
- minimize the magnitude of risk increases through the establishment of backup success paths or compensatory measures,
- and determine that the proposed maintenance is acceptable.
The comprehensive program provides much greater assurance of safe plant operation than the second Completion Times in the TS. In addition, the LAR stated the following regarding performance indicators:
NEI [Nuclear Energy Institute]
99-02, " Regulatory Assessment Performance Indicator Guideline", describes the tracking and reporting of performance indicators to support the NRC's Reactor Oversight Process (ROP). The NRC noted endorsement of NEI 99-02 in RIS 2001-11, "Voluntary Submission of Performance Indicator Data". NEI 99-02, Section 2.2, describes the Mitigating Systems Cornerstone.
NEI 99-02 specifically addresses the emergency AC power systems, the auxiliary feedwater system, and the cooling water support system. Extended unavailability due to multiple entries into the ACTIONS would affect the NRC's evaluation of the licensee's performance under the ROP. The LAR state 2_ th~ ~ollowing reg_arding administrative controls: In addition to these programs, a requirement is added to Section 1.3 of the TS to require administrative controls to limit the maximum time allowed for any combination of Conditions that result in a single contiguous occurrence of failing to meet the LCO. These administrative controls should consider plant risk and shall limit the maximum contiguous time of failing to meet the LCO. This TS requirement, when considered with the regulatory processes discussed above, provides an equivalent level of plant safety without the unnecessary complication of the TS by second Completion Times on some Specifications.
Prior to the promulgation of 10 CFR 50.65 , TSs were the primary requirements governing operations, including what equipment must normally be in service, how long equipment can be out of service, compensatory actions, and surveillance testing to demonstrate equipment readiness.
The goal of TSs is to provide adequate assurance of the availability and reliability of equipment needed to prevent, and if necessary mitigate, accidents and transients.
The MR supports this same goal by requiring a comprehensive process for performance and condition monitoring activities.
As required by 10 CFR 50.65 , the licensee assesses and manages the inoperable equipment; however, the rule also considers all inoperable risk-significant equipment.
Under the TSs, the CT for one system within an LCO is not generally affected by inoperable equipment in another LCO. However, the second CT influenced the CT for one system based on the condition of another system, but only if the two systems were required by the same LCO. Plant-specific MR programs implement risk-based configuration management programs that augment the deterministic CTs in the TSs. The performance and condition monitoring activities required by 10 CFR 50.65 identify poor maintenance practices that would result from multiple entries into the actions of the TSs which would contribute to unacceptable unavailability of these SSCs. The NRC staff finds the proposed changes to PINGP's TS 1.3 acceptable because administrative control requirements were added in Example 1.3-3 of PINGP's TSs to limit the maximum time allowed for any combination of conditions that result in a single contiguous occurrence of failing to meet the LCO and ensuring CTs are not inappropriately extended.
In addition, the licensee's MR program requires the licensee to monitor the performance or conditions of SSCs in a manner sufficient to provide reasonable assurance that SSCs can fulfill their specified safety functions and thus prevent indefinite operation without restoration of the systems. The LAR proposed change deletes the second CT associated with the following TS LCOs required actions: TS 3.6.5, A.1, C.1 , and D.2; TS 3.7.5, A.1 and 8.1; TS 3.7.8, A.1, 8.3, and D.1; TS 3.8.1, A.2 and 8.4; and, TS 3.8.9, A.1, 8.1, and C.1. These additional secondary CTs were specified for these instances to prevent repeated entry and exit from alternating TS required actions. Administrative controls will replace second CTs as described in the LAR. The NRC staff finds the proposed deletion of second CTs listed above acceptable because multiple, continuous entries into TS conditions, without meeting the LCO, will be adequately controlled by: (1) the licensee's administrative controls, (2) the configuration risk management programs as implemented to meet the requirements of the MR to assess and manage risk and performance indicators, and (3) the requirements of Section 1.3 of the TS, "Completion Times." In addition, the NRC staff finds the MR provides adequate assurance against inappropriate use of combinations of TS conditions that result in a single contiguous occurrence of failing to meet the LCO. Accordingly, consistent with TSTF-439, Revision 2, the NRC staff finds the proposed changes to PINGP TSs to be acceptable. 4.0 STATE C b NSUL TATION -In accordance with the Commission's regulations , the Minnesota State official was notified of the proposed issuance of the amendments on May 8, 2019. The State official had no comments.
5.0 ENVIRONMENTAL CONSIDERATION The amendments change the requirements with respect to installation or use of a facility component located within the restricted area as defined in 10 CFR Part 20 or change the surveillance requirements.
The staff has determined that the amendments involve no significant increase in the amounts, and no significant change in the types, of any effluents that may be released offsite, and that there is no significant increase in individual or cumulat i ve occupational radiation exposure.
The Commission has previously issued a proposed finding that the amendments involve no significant hazards consideration and there has been no public comment on such finding (83 FR 40351 ). Accordingly, the amendments meet the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9).
Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendments.
6.0 CONCLUSION
The Commission has concluded, based on the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) there is reasonable assurance that such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.
