James A. FitzPatrick Nuclear Power Plant Proposed Technical Specification Changes Pump and Valve Operability Test Program Dccket No. 50-333

Dear Sir:

Enclosed are proposed changes (Autachment A) to Section 1.0, 4.5, 4.7, and 4.11 of the FitzPatrick Technical Specifications that would conform the Specifications to the new ASME Section XI Pump and Valve Test Program for James A. FitzPatrick Nuclear Power Plant in accordance with 10 CFR 50.55a (g) (5) (ii) . The Power Authority's letters to the U.S. Nuclear Regulatory Commission dated July 26 and September 1, 1978 ccmmitted to proposal of such an amendment to the Technical Specifications.

Also enclosed is Revision 1 to the Pump and Valve Test Program (Attachment B), dated January 6, 1979. Revision 1 replaces Appendix C (Valve Test Program) of the Pump and valve Test Program, submitted to the Commission on September 1, 1978.

As required by 10 CFR 50.55a (g), the Power Authority of the State of New York submitted the Pump and Valve Operability Test Program for James A. FitzPatrick Nuclear Power Plant in a letter to the Nuclear Regulatory Commission dated September 1, 1978. The program has been prepared in accordance with Subsections IWP and IWV of the 1974 Edition of the ASME Boiler and Pressure Vessel Code through the Summer 1975 Addenda, and will be in effect for the twenty (20) month period commencing November 28, 1978. The program is consistent with the Commission's November 17, 1976 letter to the

Mr. Thomas A. Ippolito U.S. Nuclear Regulatory Commission Authority transmitting a document entitled "NRC Staff Guidance for Complying with certain Provisions of 10 CFR 50.55a (g),

Inservice Inspection Requirements". The Program will be conducted in accordance with the Power Authority's September 1, 1978 submittal, as supplemented by Attachment B of this letter, and exceptions to the ASME Code requirements taken in the Program will apply.

The proposed changes provided in Attachment A would remove the explicit requirement of monthly operability tests for power actuated valves and pumps from the surveillance requirements of Section 4.5.A thru E (Core and Containment Cooling Systems), Section 4.ll.D (Emergency Service Water System) and the operability test for all normally open power-operated primary containment isolation valves (including Main Steam Isolation Valves) from the surveillance requirements of Section 4.7.D (Containment Systems).

Instead, Section 1.0.U, " Surveillance Requirements", is added to Section 1.0 (Definitions) on page 6, effectively applying the FitzPatrick Pump and Valve Program to the Technical Specifications with language adopted from Section 4.0.5 of the Standard Technical Specifications for General Electric Boiling Water Reactors, Revision 1, April, 1978.

Surveillance requirements for the Main Steam Isolation Valves would be fulfilled as recommended in Section 4.4.7 of the Standard Technical Specifications by exercising the valves in accordance with the ASME Section XI Pump and Valve Test Program for FitzPatrick Plant.

Enclosed for filing are three (3) originals and nineteen (19) copies of a document entitled " Application for Amendment to Operating License", together with forty (40) copies of Attachment A and three (3) copies of Attachment B.

The Authority has classified this application for amendment to the operating license as Class III as it is deemed not to involve a significant environmental hazards consideration. Enclosed is a check in the amount of $4,000 as the filing fee per 10CFR Section 170.22 which the Authority pays under protest pending a final deter-mination of the legality of the fee schedule.
