Dear Mr. Chairman:

Had I not seen a copy of your letter dated May 2, 1984, to Congressman Bevill concerning " licensing delay" in the Shoreham proceeding,.I would have never believed such a letter could have been written by you. Despite the seriousness of the safety issues pending before the Commission in the Shoreham case, despite the U.S. District Court's order restraining the unconscionable hearing schedule of your Licensing Board, despite the Board's blatent misin ,

terpretation of the onsite emergency power requirement of- -

GDC 17, despite the NRC Staff's unwholesome actions in running " legal interference" for LILCO, and despite your manifestly poor judgment in having personally involved yourself with the Staff and Chief Judge on pending adjudicatory issues, you persist in writing about Shoreham in terms of " licensing delay."

What does it take, Mr. Chairman, to get across the simple fact that there is no " licensing delay" in the Shoreham case. In reality, Shoreham is still not physically complete, because -- as you and everyone else who has knowledge of Shoreham knows -- the diesel generators installed there by LILCO do not work. Any so-called " delay,"

the'refore, is LILCO's delay and not that attributable to the NRC, its regulatory process, or anyone else.

With all that has happen d. in the Shoreham case with regard - to the insensitivity and ' indifference of the NRC to the rights of Suffolk County and to the merits of the pending safety issues, I-suppose I shouldn't be but I am, nevertheless, shocked that your May 2 letter persists in promoting cliches about " licensing delay" rather than dealing with the reality of LILCO's failures at Shoreham. Common  !

courtesy would dictate that you at least attempt to correct l the record officially.
