Enclosed is the Governments' Motion For Extension of Time for Discovery on Hospital, Emergency Broadcast System, and School Issues.

We request that the Board rule promptiv on this Motion:

the discovery schedule pasently in place will expire on March 14; unless the Board provides the requested relief in the next several days, the Governments' rights to a fair opportunity to prepare for trial will have been irreparably damaged.

This Motion does not address the Board's designation of an April 15 date for completion of discovery on the "realism" issues.

The Governments oppose that schedule, and will advise the Board of the bases for their opposition in the near future.
