The Order issued yesterday afternoon in the Shoreham case raises several serious, legal issues which the Goverr.ments will address in due course.u One ambiguity requires immediate clarification, however.

Tne Order states:

The Commission will decide, on appeal, whether Governments' conduct was such as to warrant their dismissal from the entire proceeding and whether, if dismissal from the entire proceeding is not warranted, what other sanction, if any, is appropriate.

i Other matters decided in LBP-88-24 (role conflict of bus drivers, emergency broadcast system) remain before the Appeal Board.

The Governments understand from this statement that the Commission intended to segregate sanctions issues decided in LBP-88-24 from decisions on the merits of emergency planning issues which are also included in LBP-88-24.

Accordingly, the Governmente. understand that the Commission intended the OL-3 Board's decision on the merits of the legal authority 1/

Those issues may include the appropriateness of removing a portion of the Governments' appeal from the Appeal Board and the NRC's apparent assumption tha* the Governments have already been provided the opportunity to brief the issue which the NRC cer*,1fied to itself in yesterday's Order.

If this understanding is not correct, on behalf of Suffolk County, the State of New York and the Town of Southampton, I respectfully request that the Commission clarify its intent as soon as possible.
