LILCO is filing today, nevertheless, the motion to dismiss contentions 4 through 20 foreshadowed in my letter of last Friday. It is attached.

Mr. Miller's letter of today's date, telecopied to LILCO counsel about an hour after receipt of the Board's notification of the cancellation of tomorrow's confere,r}ce, does not require any modification to the attached motion.# Indeed, Mr. Miller's failure to indicate that Intervenors have any intent to modify their contentions, notwithstanding that LILCO put them on notice of its intent to argue that they have waived their opportunity to do so, merely underscores LILCo's argument.

Since responses to LILCO's attached motion will be due several days before the rescheduled date for the prehearing conference, LILCO hopes that the Board will be in a position to rule on the admissibility of contentions at the December 6 con-forence. If the Board anticipates the need for any further views by the parties prior to the conference to accomplish this goal, LILCO respectfully requests that the Board so indicate.
