I am responding to your March 9, 2007, letter in which you requested that the U.S. NuclearRegulatory Commission (NRC) brief the subcommittee on a request from FirstEnergy Nuclear Operating Company (FENOC). This FENOC request sought relaxation from the remaining two years of annual independent assessments of Operations performance at the Davis-Besse Nuclear Power Plant that were required by an NRC Order.Subsequently, FENOC withdrew this request. In its letter of withdrawal, FENOC indicated thatthey see value in the continuance of the independent assessments as the assessments provide external perspectives that will further assist Davis-Besse in achieving top industry performance.
