The U.S. Nuclear Regulatory Commission has proposed a fine of $3,000 against Hevly Technical Services, Inc. of Wentachee, Wash., for violating NRC requirements.

In a May 16 letter to the company, NRC Region IV Administrator Elmo E. Collins, said that as a result of an NRC inspection and investigation, the agency determined that the company violated NRC requirements for the possession and use of radioactive materials.

The violations occurred when the company transferred a portable moisture density gauge containing radioactive material to an Alaska company it knew was not authorized to possess or use the gauge. In addition, Hevly Technical Services used the gauge at the Alaska companys facilities when it conducted training on the operation of the gauge without prior notification to the NRC, as required.

Your transfer of radioactive material to a company (in Alaska) that was not licensed to possess and use the material was significant, because it denied the NRC the opportunity to review and inspect the Alaska company to ensure radioactive material would be used safely and as intended, Collins said in a letter to the company.

The company has 30 days to pay the proposed fine or challenge it, or 10 days to request alternative dispute resolution. The NRCs letter, its enclosures and the companys response will be made available to the public through the agencys electronic reading room at:
