Subject DTSCRIMINATION C CONTRACT EMPLOYEE ACKNOWLEDGED BY APS On August 13 1993, Arizona PubJic Service. Company (APS) informed the NRC staff that an APS supervisor had acmitted that he had declined to hire a

, contract or employee (T Saporito) because the employee had previously

raised safety concerns at Palo verde and elsewhere. This was contrary to St.atements and testimony made to the Department of Labor (DOL). APS indicated that the supervisor had stated that no one at APS had pressured

, or encouragad him to not re-hite T. Sapori t.o nor provide f alse test imony.

In addition, APS indicated that appropriate documents may not have been provadod during the discovery phase of the DOL proceeding. J I

A DOL Administ rat.ive Law Judge (ALJ) had pieviously ruled on May 10, 1993 that APS had ciscriminated against T Saporito. Although APS hud submitted in f e r:ra t i on to DOL fcr reconsiderat.non of the ALJ recommended decisio.., in letters dated Auuust 10 and 11, 1993 APS submitted to tne NRC ana I:OL information which corrects APS' previous pooition regarding discrirnnat ic . against. T. Saporito.

APS has suspended the plant access for the ind3vidual who provided the false testimony and another individual who may be implicated. Both ind(viduals are on administrative leave pending further review. The law '

A{S has issued an employee letter concerning this matter. APS has also issued a rackage of material to selected local media which includes the i most recent letters to the NRC and DOL.  !
