2. Letter, McIntyre to Quay, " Response to NRC letters concerning requests for withholding information" dated August 20,1998.

Dear Mr. Quay:

1 Reference I sets forth the NRC assessment of the Westinghouse claim for treatment of proprietary information submitted by Westinghouse in a letter dated November 17,1995, which letter provided responses to staff RAls on the AP600 Design Certification Test Program, NOTRUMP computer code, WCOBRA/ TRAC computer code and LOFTRAN computer code. The NRC assessment was that the material identified as proprietary would be withheld, with the exception ofinformation marked as proprietary in the Westinghouse responses to RAls 440.343 and 440.351. The staff claimed that the material identified in the responses to these two RAIS should not be considered as Westinghouse ,

I proprietary information since the statements were of a general nature or the information related to the CCTF test program, which is available in the open literature.

approach used by Westinghouse to develop the analysis models of the CCTF test facility which was used to support validation of the aforementioned computer codes for the AP600 Design Certification ..

In neither RAI response is any information available in the open literature in regards to the CCTF test program considered as Westinghouse proprietary information.

Reference 2 provided the Westinghouse response to the staff assertion. During telephone calls with

' the staff on August 25 and 26,1998, the NRC technical staff continued to disagree with the l

Westinghouse assertion of proprietary material in our responses to RAI 440.343, item a) and RAI 440.351, item b),2nd paragraph. It was explained that for Westinghouse to maintain the AP600 l FDA schedule, this issue needed a rapid resolution and that modifications to the original RAI l l

- responses would require further staff review. Therefore, wh eil Westinghouse believes the requirements 1 of 10CFR2.790(b)(4) are met for the information in question, Westinghouse agrees to consider the information discussed to be nonproprietary, as shown in Enclosure 1, to expedite the AP600 FDA. '

Enclosure 2 is the nonproprietary version of Enclosure 1. These revised responses to RAI 440.343 and RAI 440.351 supercede those submitted to the staff in our letter dated November 17,1995.

The Westinghouse Electric Company, a division of CBS Corporation (" Westinghouse"), copyright notice, proprietary information notice, application for withholding and affidavit are attached.

This submittal contains Westinghouse proprietary information consisting of trade secrets, commercial information or financial information which we consider privileged or confidential pursuant to 10CFR2.790. Therefore, it is requested that the Westinghouse proprietary information attached hereto be handled on a confidential basis and be withheld from public disclosures.

This material is for your internal use only, and may be used for the purpose for which it is submitted.

It should not be otherwise used, disclosed, duplicated, or disseminated, in whole or in part to any other person or organization outside the Commission, to Office of Nuclear Reactor Regulation, the Office of Nuclear Regulatory Research and the necessary subcontractors that have signed a proprietary non-disclosure agreement with Westinghouse without the express written approval of Westinghouse.

Correspondence with respect to the application for withholding should reference AW-98-1277, and should be addressed to Brian A. McIntyre, Manager of Advanced Plant Safety and Licensing, Westinghouse Electric Company, a division of CBS Corporation (" Westinghouse"), P.O. Box 355, Pittsburgh, Pennsylvania..15230-0355.

This revised response addresses the proprietary issues delineated in the reference.
