Reference I sets forth the NRC assessment of the Westinghouse claim for treatment of proprietary

.information submitted by Westinghouse in two letters, NSD-NRC-94-4243 dated July 29,1994, and NSD-NRC-97-5088 dated April 28,1997, which letters provided to the staff documentation of the AP600 PCS Final Data Report, WCAP-14135, Westinghouse Proprietary Version and WCAP-14138, Westinghouse Nonproprietary Version. The staff asserts that it cannot complete its proprietary determination review of the documentation because of the following documentation deficiencies: ,

1 o WCAP-14138, the nonproprietary version of WCAP-14135, reveals information that is marked as proprietary. l o The nonproprietary version (WCAP-14138) and the proprietary version (WCAP-14135) of the report indicate different reasons for the proprietary claim.

I o The drawings contained in WCAP-14135, Revision 1, submitted on April 28,1997, are marked as proprietary, however, the reasons the drawings are considered proprietary is

DCP/NRCl428 NSD-NRC-98-5771 August 21,1998 To address the first two issues Westinghouse is submitting Enclosure 1, Revision 2 of WCAP-14138, I "AP600 PCS Final Data Report, August,1998, Westinghouse Nonproprietary Version," which has l l been updated to remove all information that is marked as proprietary and to indicate reasons for the i l proprietary claim consistent with WCAP-14135, Revision 1. This submittal also satisfies the verbal commitment to revise the nonproprietary version of the PCS Final Data Report made by Westinghouse during the August 28,1997, telecon between Mr. B. E. Rarig of Westinghouse and Ms. D. T. Jackson of your staff.

The drawings labeled as proprietary in WCAP-14135, Revision 1, are drawings of the as-built test facility and, as such, are considered to be proprietary to Westinghouse for the following reasons:

a. The information reveals the distinguishing aspects of a process (or component, structures, tool, method, etc.), where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies, and
c. Its use by a competitor would reduce the expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of ,

I quality, or licensing a similar product.

These reasons are noted in Appendix A of WCAP-14138, Revision 2. j l

Reference 2 sets forth the NRC assessment of the Westinghouse claim for treatment of proprietary information submitted by Westinghouse letter, NSD-NRC-94-4243 dated December 20,1993, which letter provided to the staff a Technical Description Package (TDP) of Blind Test 220.1. The staff )

requests that Westinghouse provide a nonproprietary version of the submitted documentation. I As described in our submittal of December 20,1993, Westinghouse incorporated the results of Blind Test 220.1 in Revision 1 of WCAP-14135 as submitted to the stalTin our letter NSD-NRC-97-5088 dated April 28,1997, on change pages 4-142 through 4-156. With the publication of the PCS Final Data Report (WCAP-14135, Revision 1), the preliminary identification is now removed and the nonproprietary version of the Final Data Report (WCAP-14138, Revision 2) has been prepared and submitted. Therefore, a nonproprietary version of the TDP for Blind Test 220.1 is not required, the test results having been incorporated in both the proprietary and nonproprietary versions of the PCS Final Data Report.

Reference 1 also notes that since the staffs safety evaluation of the AP600 design relies only on WCAP-14135, Revision 1, the staff plans to return the Revision 0 of WCAP-14135 submitted July 29,1994.
