( By letters dated November 28,1995, and November 30,1995, the staff informed EPRI that it I could not make a proprietary determination in accordance with the requirements of 10 CFR 2.790 <

on the following EPRI documents

" GOTHIC Containment Analysis Package Qualification I Report," dated September 1993, " GOTHIC Containment Analysis Package Qualification Manual,"

dated September 1993, " GOTHIC Containment Analysis Package Qualification User Manual,"

dated September 1993, and " Gothic Design Review, Final Report," dated September 1993. The i

reasons given for the staff's decision,' although agreeing that proprietary information existed in the reports, were a lack ofidentifiable proprietary markings and a need for non-proprietary versions of the reports for public disclosure. However, following the staff's review of the Royality-

. ' Free License Agreement for the GOTHIC computer code between the NRC and EPRI, dated LJune 13,1996, it has been determined that nonproprietary versions of the reports are not P necessary. Therefore, the above reports will be withheld from public disclosure.

. Withholding from public inspection shall not affect the right, if any, of persons properly and directly concemed to inspect the document. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the  ;

i consultants have signed the appropriate agreements for handling proprietary information. -If the q i-. basis for withholding this information from public inspection'should change in the future such that l i the information could then be made available for public inspection, you should promptly notify the .
