Reference:

1. Letter, Huffman to McIntyre, " Request for withholding information from public disclosure for Westinghouse AP600 design letter of November 17,1995," dated February 29,1996.

Dear Mr. Quay:

Reference I sets forth the NRC assessment of the Westinghouse claim for treatment of proprietary information submitted by Westinghouse in a letter dated November 17,1995, which letter provided responses to staff RAls on the AP600 Design Certification Test Program, NOTRUMP computer code, WCOBRA/ TRAC computer code and LOFTRAN computer code. The NRC assessment was that the material identified as proprietary would be withheld, with the exception of information marked as proprietary in the Westinghouse responses to RAls 440.343 and 440.351. The staff claimed that the material identified in the responses to these two RAls should not be considered as Westinghouse proprietary information since the statements were of a general nature or the information related to the CCTF test program, which is available in the open literature.

Westinghouse considers the material as marked to be proprietary since the material discusses the approach used by Westinghouse to develop the analysis models of the CCTF test facility which was used to support validation of the aforementioned computer codes for the AP600 Design Certification as' requested by staff and discusses the methodology used by Westinghouse to develop appropriate input for those analysis models. In the response to RAI 440.343, the sentence so marked as proprietary contains information related to the input of the analysis models used by Westinghouse to achieve the comparison with the CCTF test data in the response to RAI 440.348(c). In the response to RAI 440.351, the material so marked as proprietary discusses a unique Westinghouse approach to computer code modeling of the CCTF test facility in order to develop an apprq riate analytical tool.

l In neither RAI response is any information available in the open literature in regcds to the CCTF test program considered as Westinghouse proprietary information.
