Dear Mr. McIntyre:

By your letter (DCP/NRC-0985), dated August 21,1997, Westinghouse submitted a response to  !

concems of the U.S. Nuclear Regulatory Commission (NRC) regarding your quality assurance (QA) program and requested that the response be withheld from public discic,sure. The request {

was made in accordance with 10 CFR 2.790 and was supported by an affidavit (AW-97-1152),

executed by you on August 21,1997. Your request for withholding was denied by my letter dated July 15,1998.

By your letter (DCP/NRC-1419), dated August 21,1998, Westinghouse clarified its request for withholding and stated that "the information contained in the Westinghouse letter of August 21, j 1997, is a self-critical analysis of the Westinghouse QA program and, therefore, falls under item  !

(4)(ii)(c) of affidavit AW 97-1152." We have reviewed your original submittal and supplemental justification in accordance with the requirements of 10 CFR 2.790 and, on the basis of Westinghouse's statements, have determined that the submitted information sought to be withheld reveals commercial strategies of Westinghouse and its suppliers. Therefore, we have determined that the information enclosed in Westinghouse letter DCP/NRC-0985, dated August 21,1997, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
