OF DECEMBER 13, 2023, MEETING WITH TENNESSEE VALLEY AUTHORITY REGARDING A PROPOSED CHANGE TO THE TENNESSEE VALLEY AUTHORITY NUCLEAR QUALITY ASSURANCE PLAN (EPID L-2023-LRM-0103)

On December 13, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff conducted an observation meeting with representatives of the Tennessee Valley Authority (TVA). The purpose of the meeting was to discuss TVAs proposed conversion of its Nuclear Quality Assurance Plan (NQAP) from American National Standards Institute (ANSI) N45.2-1971, Quality Assurance Program Requirements for Nuclear Facilities, to American Society of Mechanical Engineers (ASME) NQA-1-2015, Quality Assurance Requirements for Nuclear Facility Applications.

TVA stated that it plans to request NRC approval of a revision to its operating fleet NQAP by transitioning the plan to ASME NQA-1-2015, which is endorsed by Regulatory Guide (RG) 1.28, Revision 5, Quality Assurance Program Criteria (Design and Construction). The plan would also follow guidance in American National Standards Institute/American Nuclear Society (ANSI/ANS) 3.2-2012, Managerial, Administrative, and Quality Assurance Controls for the Operational Phase of Nuclear Power Plants, which is endorsed by RG 1.33, Revision 3, Quality Assurance Program Requirements (Operation).

TVA stated that the purpose of transitioning the NQAP is to support the future state of the operating fleet and new nuclear builds (e.g., at the Clinch River site). TVA previously submitted NNP-TR-001-NP, Revision 0, Quality Assurance Program Description (QAPD) For TVA New Nuclear Program (hereinafter referred to as TVA New Nuclear QAPD) to the NRC for approval.

The NRC staff has found that the TVA New Nuclear QAPD is acceptable for referencing in the Clinch River Nuclear Site construction permit license application, with the limitations and conditions (ML23254A050).

TVA stated that it plans to adopt the most recent quality-related NRC RGs with the exception of RG 1.28, Revision 6. TVA will also submit a New Nuclear Quality Assurance Plan after issuance of the safety evaluation noted above.

TVA enumerated the key updates and alternative commitments planned for the revised NQAP, notably maintaining commitments to historical design and construction standards in effect when plants were built; maintaining a commitment to alternative administrative processes versus ANSI/ANS 3.2-2012 requirement for 2-year procedure review; and maintaining a 36-month periodicity for internal audits of Appendix B, Quality Assurance Criteria for Nuclear Power Plants and Fuel Reprocessing Plants, to Part 50 of Title 10 of the Code of Federal Regulations (10 CFR Part 50, Appendix B) activities. Additionally, where ANSI/ANS 3.2-2012 references NQA-1-2008 and NQA-1-2009 addenda for requirements, TVA Nuclear will follow NQA-1-2015.

The request will be accompanied by a request to revise the TVA plants technical specifications (TS) to delete the specific revision of RG 1.33 that is cited in TS 5.4.1.a, and instead refer to the revision of RG 1.33 that is specified in the TVA NQAP. This will allow flexibility for TVA to adopt future revisions of RG 1.33 without having to submit a license amendment request.

TVA plans to submit the request by January 31, 2024, and will request approval within 1 year.
