OF AUGUST 19, 2020, PUBLIC WEBINAR WITH NEXTERA ENERGY DUANE ARNOLD, LLC TO DISCUSS FUTURE REQUEST FOR A ONE-TIME EXEMPTION TO CERTAIN REQUIREMENTS OF 10 CFR PART 50, APPENDIX E AT DUANE ARNOLD ENERGY CENTER (EPID L-2020-LRM-0078)

On August 19, 2020, a Category 1 public webinar was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of NextEra Energy Duane Arnold, LLC (NextEra, the licensee) via a webinar. The purpose of the webinar was to discuss with NextEra the planned proposed request for a one-time exemption to the requirements of Title 10 of the Code of Federal Regulations (10 CFR) Part 50, Appendix E, Sections IV.F.2.b and IV.F.2.c for the Duane Arnold Energy Center (DAEC). Specifically, the licensee was considering requesting a one-time scheduler exemption to postpone the current scheduled biennial emergency preparedness (EP) exercise until 2021. No regulatory decisions were made during the meeting.

The meeting notice dated August 14, 2020, is available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML20231A625. A list of attendees is enclosed.

Discussion During the meeting, the licensee indicated that there were two drivers for the proposed exemption request regarding EP exercise exemption for DAEC:

1) The Coronavirus Disease 2019 (COVID-19) public health emergency and its mitigating measures need reduction in staff at site for worker health and safety, and conducting EP exercises will need additional staff, which may increase the risk of spread of the COVID-19.
2) DAEC is currently in shutdown status due to a severe storm event on August 10, 2020.

The licensee stated that DAEC will remain permanently shut down and NextEra will provide a revised letter to the NRC, indicating the early decommissioning decision and cessation of operations, from the original planned date of October 30, 2020. Further, the licensee stated that in the light of plant shutdown, performing EP drills associated with an operating plant has less value.

The NRC staff highlighted the necessary criteria and expectations for staff review of the proposed submittal for exemption. The NRC staff clarified that 10 CFR Part 50, Appendix E, Sections IV.F.2.b and IV.F.2.c are separate NRC regulations and the licensee should refer to NRC staffs guidance in NRC letter to industry dated May 14, 2020 (ADAMS Accession CORRECTED No. ML20120A003), and Regulatory Issue Summary (RIS) 2006-003, Guidance on Requesting an Exemption from Biennial Emergency Preparedness Exercise Requirements, dated February 4, 2006 (ADAMS Accession No. ML053390039), for Part 50 licensees seeking exemptions on this topic. Also, that approval of a licensees exemption request for IV.F.2.c would not address 44 CFR Part 350. The NRC staff noted that its role in the regulatory process is to maintain reasonable assurance of adequate protection of safety in the event of radiological emergency. The NRC staff also mentioned that it is open to flexibility in ideas in implementing the drills to ensure healthy and safety, such as conducting virtual drills. The licensee indicated that it is aware of NRCs guidance and criteria and did not have specific questions for NRC staff.

The licensee indicated that it will submit the application for the proposed exemption in the week of August 24, 2020.

One member of the public, Ms. Angela Leek, Bureau Chief, Bureau of Radiological Health, Iowa Department of Public Health, was in attendance. Ms. Leek stated that with the early decommissioning of the plant, the EP drill is of less value in the current scenario, and further added that she supports NextEras request for the one-time exemption on EP exercises.
