(Seabrook Station, Units 1 and 2) ) November 17, 1986 SERVED NOV 181986 MEMORANDUM AND ORDER On November 14, 1986 this Board received Town of Hampton Motion For Clarification And For Reconsideration of our order of November 4,1986.

T0H seeks to have the Board " permit participants to file contentions on all issues raised by Revision 2 of NHRERP, including matters initially contained in Revision 1, and incorporated into Revision 2, and matters raised by FEMA or RAC comments, infra, whether or not these issues constitute 'new matters solely contained in Revision 2.'"

In its arguments in support of this motion, T0H attempts to introduce confusion where no confusion exists. Each volume of the 31 volumes issued in Rev. 2, August 1986 clearly states "The plan has been updated and revised as of the date shown on the Notice of Revision Sheet." (Record of Revision, page -v , Rev. 2 August 1986). The plan 8611200141 861117

republished as Revision 2 is the state's current plan with all prior revisions considered and either adopted by incorporation or rejected through omission. Where there is new matter not contained in the NHRERP but contained in Rev. 2 of NHRERP participants may file contentions based only on the new matters incorporated into Revision 2. Any contention filed must meet late-filed requirements of this Commission.

Whatever it is T0H seeks in its discussion of Revision 1 of NHRERP at I.2.0 on page 3 is without merit. The Board has consistently directed participants in this proceeding to Revision 2 of the NHRERP for the filing of late contentions due in-hand to the Board on December 1, 1986.

The status report filed by T0H is acceptable to the Board since it reflects those matters current for T0H in this proceeding. For this Board a " negative report" indicates that there is no matter the participant wishes to call to the attention of the Board which impacts upon the conduct of this proceeding.
