ORDER The intervenors Attorney General of Massachusetts and New England Coalition on Nuclear Pollution have filed a protective notice of appeal from the Licensing Board's June r

1990 memorandum and order in this operating-license 27, proceeding involving the Seabrook nuclear power facility.I

.The-appeal is summarily dismissed as premature on the authority of ALAB-933.2 As we there determined, an appeal from the Licensing Board's resolution of a_ny of the-issues remanded to that Board in ALAB-924 must await the Board s The June 27 memorandum disposition of all of those issues.

o and order does contain the Board's final word on one of the j

two remanded issues still open when ALAB-933 was rendered (that concerned with the sheltering of.the beach-population).

But it explicitly leaves undecided the other-such issue-(that concerned with the evacuation of advanced lif e' support patients). 4 i

It is so ORDERED.

-4 Given their clear interrelationship in this instance, we see no compelling reason to consider the Licensing Board's denial in LBP-90-12, 31'NRC ~

(May 3, 1990), of the intervenors' motions to reopen the record on beach sheltering matters in advance of the appellate consideration of the action taken by the Board on the remanded issue directed to that subject.
