MEMORWDUM AND ORDER On full consideration of the views of the respective parties as set forth in their responses to our unpublished July 10, 1989 order, we conclude that the Licensing Board's 1

June 23, 1989 memorandum and order is not now appealable. l Accordingly, the appeal .taken by the Attorney General of Massachusetts from the June 23 issuance is dismissed.

The basis for our conclusion is that, contrary to the belief of the Licensing Board, the ~une 23 memorandum and order cannot reasonably be regarded as having disposed of a major segment of the full-power operating license proceeding 890B070116 090B01 -

and, thus, as'having satisfied the finality test established-long.ago for appealability' purposes.3 The sole issue considered and' decided by the Board below pertains to'the adequacy.of the applicants' proposed siren system for notifying persons within the Massachusetts. portion of the Seabrook plume exposure pathway ~ emergency planning zone (EPF) of a radiological emergency at-the facility. Given the: numerous and diverse other emergency planning issues relating to that portion of the EPZ that still await Licensing Board determination, we are unable to endorse the insistence of the Attorney General and the NRC staff that the Licensing Board correctly looked upon the siren issue as being a major, rather than merely a discrete, segment of the proceeding. In the circumstances, the Attorney General's

-challenge to the June 23 issuance must await the disposition below of the other pending Massachusetts EPZ matters.
