MEMORANDUM AND ORDER Before us is the May 3, 1989, motion of the interveners to hold argument in New Hampshire on their pending appeals from the Licensing Board's December 30, 1968, partial {

l initial decision in this operating license proceeding l involving the Seabrook nuclear facility.1 The motion is d_enied. We are given insufficient reason to depart from our 4

customary practice of holding oral argument in the NRC Public Hearing Room in Bethesda, Maryland. In almost all instances where there has been a departure from that practice, the Appeal Board desired to conduct a visit to the facility site or its environs in conjunction with the oral See LBP-88-32, 28 NRC 667.

'2 argument. That was the. case with respect to the two prior oral arguments involving the Seabrook facility (one in.1976 and the other in 1987).that, as the interveners note, were conducted in New Hampshire. No cause now exists for a further visit to the Seabrook' area.

'Moreover, at appellate arguments, there'is no room for oral presentations'by persons other than the official-representatives of the parties. Thus, the argument need not l

be held in New Hampshire to accommodate the participation of members of'the general public. For the benefit of the public, in addition to other reasons, it will be stenographically transcribed, as is'always the case.

Accordingly, the oral argument will be. held in Bethesda on the~ morning of July 27, 1989.3 At least ten days before that date, a formal argument order'will issue setting the allocation of time for each side to present its argument.

stenographic transcript of,the oral' argument is placed in l l the-local Public Document Room in.Exeter, New Hampshire, as expeditiously as possible. From an examination of the transcript, interested persons in the Seabrook area who are unable to attend the argument will be able to ascertain precisely what transpired at it.
