MEMORANDUM AND ORDER l In ALAB-939, September 28, 1990, 32 NRC , the Appeal g Board directed this Board to ensure that several matters relating to the condition (1) " shelter-in-place" protective option for the summer beach population be clarified. Slip op. at 27-29.

First, since the evidence indicates that automobiles are assigned no cloudshine sheltering factor, the record must contain an adequately supported explanation, in terms of achieving maximum dose reduction, for distinguishing between that portion of the general beach population (with l

t transportation), who will be directed to remain within I shelters, and those who will be directed to go to their cars and evacuate. Id. at 27-28.

Second, given the testimony of New Hampshire officials suggesting the need to distinguish between suitable and unsuitable shelter, the record must be clear as to whether such measures are necessary relative to the " shelter-in-place" option as now described by the State. Id. at 28.

Finally we must ensure that any EBS/ beach population public address message propored for condition (1) makes ,

- clear the steps that all members of the beach population are to take in the event that " shelter-in-place" is recommended.

Id. at 28-29.

The Licensing Board believes that advice on all three matters sent down from the Appeal Board in ALAB-939 would be helpful. Therefore, we direct all eligible parties wishing to participate in the resolution of these matters to submit memoranda setting forth their respective views. Further, we request that the State of New Hampshire and the Federal Emergency Management Agency also participate. Memoranda should be in the hands of the members of the Licensing Board no later than December 7, 1990. Counsel for the parties are directed and counsel for the State of New Hampshire and FEMA are requested to appear at the prehearing conference set for i
