MEMORANDUM AND ORDER We have before us the notice of appeal of the Attorney General of Massachusetts from the Licensing Board's June 23, 1989, memorandum and order with respect to the applicants' proposed siren system for notifying persons within the Massachusetts portion of the Seabrook plume exposure pathway emergency planning zone of a radiological emergency at the facility.1 The memorandum and order was subtitled " Final Initial Decision" and also concludes with the Board's notation that it disposes of "a discrete and major segment of the full power operating license proceeding."2 We See LEP-89-17, 29 NRC . 1 9

4 2 entertain, however, some doubt that such is the case. To the contrary, :it appears to us at first blush that the siren issue represented but a'very small portion of the issues that awaited decision'on June 23 -- all of the remainder of which issues are still undecided. True, tha so-called "onsite" Board, in contrast to the'"offsite" Board which has long had.before it all of the myriad full-power emergency planning matters other than sirens, concluded its work in this' proceeding with the June 23 issuance (which may explain the subtitle placed on the memorandum and order). But it is at least questionable whether, standing alone, that consideration can convert <he siren issue into a " major," as opposed to simply a " discrete," segment of the proceeding.

For these reasons, we are calling for the views of the parties on the appealability question, i.e., on whether the June 23 issuance is interlocutory and, thus, is not subject to an appeal at this time.3 Those views shall be set forth in memoranda to be filed on or before July 26, 1989.

Pending further order of this Board, the time for the filing of the Attorney General's brief in support of his appeal is tolled.
