ORDER Oral argument on the appeals of the Seacoast Anti-Pollution League and Attorney General of Massachusetts from the Licensing Board's March 8, 1989, memorandum and order will be heard at 10:00 a.m., Wednesday, July 12, 1989, in the NRC Public Hearing Room, Fifth Floor, East-West Towers Building, 4350 East-West Highway, Bethesda, Maryland.

The argument will encompass not merely the issues raised by the appeals but, additionally, the issue presented by the motion of the NRC staff to strike the notices of appeal (i.e., to dismiss the appeals) on the ground that the March 8 order is interlocutory in character and, as such, not appealable at this time.

on the' appealability matter,.each party is to be prepared to address these questions: Should the consideration of a petition under 10 CFR 2.758(b) seeking the waiver of the application of a specified Commission regulation in a particular proceeding be deemed ancillary to that proceeding? If'so, does the Licensing Board's denial' of such a petition have the ' requisite finality for appeal purposes irrespective of the then status of the proceeding?

On the merits, the parties will undoubtedly find it advisable to focus upon the rationale underlying the Commission's disposition in its December 21, 1988, decision of the then pending petitions to waive its rule that makes a finding of financial qualification unnecessary in the case of operating license applicants such as the owners of the Seabrook facility. In this connection, specific attention appropriately will be paid to the significance attached by the Commission to the operation of the New Hampshire statute concerned with the preclusion of the grant of certain rate relief to an electric utility in advance of full-power commercial operation.4 We intend to explore the parties' views on the relevance of the Commission's discussion of 2

3 that statute to the. petition now at hand, as well as their views on other portions of the analysis of the waiver question to be found in the December 21 decision.

Each side will have 50 minutes for the presentation of' argument.5 The'appel'lants may reserve a reasonable portion of their time for rebuttal.

The Secretary to this Board shall be provided, by letter mailed no later than July 3, 1989, with the name of the person who will present argument on behalf of the particular party..
