SUBJECT:

DIABLO CANYON ALLEGATIONS REGARDING STAFF CONDUCT During the course of our review of the allegations related to the Diablo Canyon Nuclear Power Plant, we have identified a number of allegations which explicitly or implicitly concern the NRC staff's conduct of the allegation reviews.

While there are no established procedures for assigning review responsibility for specific allegations to 0IA, we have identified two of the allegations currently assigned to NRR which we believe are directly related to 0IA's function and should be more appropriately evaluated by your office. These allegations are # g and # Q]8; the source documents for these allegations are enclosed. From a technical standpoint, we have concluded that these issues do not affect the safe operation of the plant. We request that you evaluate these allegations and prepare a written evaluation which can be included in a future SSER for Diablo Canyon. Please contact Hans Schierling (X271001 or George Knighton (X27161) to arrange a mutually agreeable schedule for this review.

We have identified several other allegations assigned to NRR which we believe involve technical differences of opinion or judgment between the staff and the alleger, rather than issues of staff misconduct. These allegations are:
