PROPOSED LETTER TO APPLICANT - DIABLO CANYON NUCLEAR POWER PLANT - CULTURAL RESOURCES Enclosed is a draft letter to the applicant requesting further information in making a determination of effect which the operations and maintenance of the plant may have on the SLO-2 archeological site on Diablo Canyon property. The information being requested is in addition to the infonnation which was pro-vided by the epplicant in their September 29, 1983 response to the Nuclear Reculatory Carnission request of March 28, 1983. .

In my letter of March 28, 1983, the NRC requested information required to complete a determination of the effect which'Iperation and maintenance activities of the plant may have on the Diablo Canyon SLO-2 archeological site. You were requested to follow the steps presented in 36CFR800.3 and 36CFR800.4 in developing the information. ,

In your September 29, 1983 response to the March 28, 1983 letter, you refer to 36CFR800.3(a) and 36CFR60.4, and to the Archeological Resources Management Plan (AP"P) and its appendices, April 1980, which is referenced in Appendix B of the Environmental Protection Plan. You stated that the ARMP and appendices in conjunction with the Operational License provides sufficient protective measures to assure the integrity of SLO-2 during operation and naintenance of the plant.

Your response is' inadequate in several respects for us to go forward with the deternination of effects process. Specifically we request a resubnittal from you which explicitly addresses the steps in 36CFR800.4(b), (c) or (d). You will note the steps require referral back to 36CFR800.3 covering application of the criteria of effect and adverse effect and also to 36CFR800.13 covering adequate documenta tion. lle require a report docunenting the analysis you performed in naking the determination of effect finding.
