Dear Ms. Garde:
This is in further response to your letter dated January 21, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), records related to the NRC Comanche Peak Task Force established in March 1984.
We are now placing a box of allegation tracking system records, which are described on the enclosed Appendix R, in the NRC Public Document Room (PDR) in file F01A-85-59 under your name.
Portions of the records identified at numbers 224, 226 through 258, and 274 contain information that is being withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations. The withheld portions contain the advice, opinions, and recommendations of the staff concerning potential violations. The nonexempt portions of these records are being placed in PDR file F01A-85-59 under your name.
Pursuant to CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public int'erest. The persons responsible for this denial are the undersigned and Mr. Harold R. Denton, Director, Office of Nuclear Reactor Regulation.
This denial may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter. Any such appeal must be in writing, l addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

A separate set of the released records is being made available for public inspection and copying at the Local Public Document Room (LPDR) located at the University of Texas Library, 170 South Cooper Street, Arlington, Texas.
Additional records subject to your request are currently under review and will be placed in the PDR and LPDR in the coming weeks.

TRANSFER OF COMANCHE PEAK ALLEGATION TO OI POR REVIEW On March 19, 1984, the Government Accountability Project (GAP) submitted various allegationa concerning Comanche Peak to the NRC. A copy of the GAP submittal and associated documentation developed by the Technical Review Team is enclosed. These issues were included in the technical issues and allegations scheduled for review by the T cal Review Team.
One of the CAP allegations (Ites 18 of the GAP lett ) concerns " Material false statements by plant management e At Safety and Licensing Board." As discussed between Mr. R. Wessaan of the Technical Review Team and H. Brooks Grif fin of your office on August 7,1984, this allesation appears to be appropriate for evaluation by your office.

ALLEGATIONS FROM GOVERNMENT ACCOUNTABILITY PROJECT (GAP)
On August 10, 1984, the Region IV Office of Investigations Field Office ,
received from the Comanche Peak Steam Electric Station (CPSES) TRT a GAP allegation related to a material false statement made tf the CPSES plant '
management to the ASLB. This allegation was contained in a March 19, 1984 GAP letter to Mr. DeYoung with I&E.
On August 10, 1984, the reporting investigator telephoned Billie Garde at GAP l
headquarters. Ms. Garde said this allegation referred to Heyward Hutchinson's testimony before the CPSES ASLB. Mr. Hu'chinson had bean interviewed by this investigator on February 27, 1984, and a transcript of the interview was provided to the ASLB. The events surrounding this incident were reported under Report of Inquiry No. Q4-84-014.
The CPSES ASLB has already ruled on the C NA prenotification issue. No further investigation is anticipated.

If any records as defined in 10 C.F.R. 5 9.3a(b) and the NRC Hanual, supra, and covered by this request have been destroyed and/or removed after this request, please provide all surrounding records, including but not limited to a list of all records which have been or are destroyed and/or removed, a description of the action (s) taken relevant to, generated in connection with, and/or issued in order to implement the action (s).
GAP requests that fees be waived, because " finding the information can be con-sidered as primarily benefitting the general public," 5 U.S.C. 5 552(a)(4)(a).
GAP is a non-profit, non-partisan public interest organization concerned with honest and open government. Through public outreach, the Project promotes whistleblowers as agents of government accountability. Through its Citizens Clinic, GAP offers assistance to local public interest and citizens groups seeking to ensure the health and safety of their communities. The Citizens Clinic is currently assisting several citizens groups, local governments and ,
intervenors in the central Texas area concerning the construction of the Comanche Peak nuclear power plant.
