Energy Company (NNECO) waive any assertion of the statute of limitations for 60-90 days with respect to NRC's ability to initiate a civil penalty action based upon an  !

apparent violation of 10 CFR 50.9 involving an October ia,1993, Licensee Event i

Report (LER 93-011-00). On behalf of NNECO, this letter contirms such a waiver of the statute of limitation on this matter. i l

NNECO makes this waiver in order to permit the NP.C mfficient time to fully and fairly review this matter. Accordingly, and although the Company is certainly eager to have ,

this matter promptly resolved, NNECO does not c51oose to place a time limit on this waiver at this time. However, if NRC does not tako action to close this matter within U 90 days, you have agreed to notify NNECO as 'o ine procedural status of this matter.
