IMPOSITION OF CIVIL PENALTY - $50,000 By EN 85-11 dated February 13, 1985, the Commission was notified of the intent of IE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 to the Duke Power Company. This action involved the failure of the Upper Head Injection (UHI) accumulator system isolation valves to close at the required UHI accumulator water level at Duke's McGuire facility.

i The licensee responded to the Notice in a letter dated March 22, 1985. After consideration of the licensee's response, the staff concluded that the violation did occur and that mitigation of the civil penalty is not warranted. Accordingly, an Order Imposition Civil Monetary Penalty in the amount of Fifty Thousand i Dollars ($50,000) has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
