PROPOSED IMPOSITION OF CIVIL PENALTY - $100,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of One Hundred Thousand Dollars
($100,000) will be issued on or about October 28, 1987 to Duke Power, Company.
This action is. based on an event in which one of two required emergency diesel generators was rendered inoperable for approximately 90.5 hours5.787037e-5 days <br />0.00139 hours <br />8.267196e-6 weeks <br />1.9025e-6 months <br />.
The escalation and mitigation factors of the Enforcement Policy were considered and in this case the civil penalty was increased-by 100 percent because of past poor performance.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice October 28, 1987 Telephone Notification of Licensee October 28, 1987 The State of North Carolina will be notified.
The licensee has thirty. days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed _by Order.
