May 28, 1986 EN 86-35 0FFICE OF INSPECTION AND ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Duke Power Company Docket No. 50-369

Subject:

PROPOSED IMPOSITION 0F CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty Thousand Dollars ($50,000) will be issued on or about June 2,1986 to Duke Power Company for its McGuire Nuclear Station, Units 1 and 2. This action is based on the failure to meet the Unit 1 Technical Specification requirements in that a Limiting Condition was exceeded and appropriate measures were not taken. Specifically, two valves required to isolate the Volume Control Tank upon the initiation of a safety injection signal were in the open rather than closed position when the plant entered operational Modes 2 and 3 on November 2, 1985.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Director, Office of Inspection and Enforcement, to sign this action. The schedule of issuance and notification is:

The licensee has thirty days from the date of the Notice ir. which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
