PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 By EN 86-35, dated May 28, 1986, the Comission was notified of the intent of IE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 to Duke Power Company. This action was based on a violation involving the failure to meet _ technical specification requirements where two valves required to isolate the Volume Control Tank upon a safety injection signal were in the open rather than closed position on November 2, 1985.
The licensee responded to the Notice in letters dated July 2 and 22, 1986.
-After careful consideration of the licensee's responses, the staff has concluded that the violation did occur as set forth in_ the Notice of Violation and Proposed Imposition of Civil Penalty and that a sufficient basis for reduction of the proposed civil penalty was not provided in their responses.
Accordingly, an Order Imposing Civil Penalty in the amount of $50,000 has been.
issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
