IMPOSITION OF CIVIL PENALTY - $100,000 By EN 87-94 dated October 23, 1987 the Comission was notified of the intent of the staff to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of One Hundred Thousand Dollars-($100,000) to Duke Power Company. This action was based on a violation involving an event in which one of two required errergency diesel generators was rendered inoperable for approximately 90.5 hours5.787037e-5 days <br />0.00139 hours <br />8.267196e-6 weeks <br />1.9025e-6 months <br />.

The licensee responded to the Notice in a letter dated November 25, 1987. After careful consideration of the licensee's response, the staff has concluded that a sufficient basis for reduction of the proposed civil penalty was not provided.

Accordingly, an Order Imposing Civil Penalty in the amount of $100,000 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
