Gentlemen: '

By letter dated January 12, 1993 (PY-CEI/NRR-1584L), a proposed revision to the Perry Nuclear Power Plant (PNPP) Emergency Plan vas_ submitted, to incorporate  ;

Emergency Action Levels (EALs) which are based on the methodology outlined in  !

NUMARC/NESP-007 " Methodology for Development of Emergency Action Levels"-

(Rev. 2 January 1992).

On February 5, 1993, a meeting was held to discuss the PNPP proposal, and NRC subsequently provided comments on the EALs by letter dated April 20, 1993. Our  ;

letter dated May 20, 1993 (PY-CEI/NRR-1646L) provided revisions to the EALs

which responded to the NRC comments.

Further review by the NRC staff has resulted in one additional change to-conform the PNPP EALs more closely to the NUMARC guidance. The proposed change ,

is on page 4-12 of the Emergency Plan pages which are included as an attachment to this letter. This change is being made to Table A-1 " Fission Product Barrier Degradation" (see April NRC letter,Section III.B.3.b). The change adds an additional EAL conditic1, such that a General Emergency vill be declared whenever reactor vessel vater level is reduced below the bottom of active fuel, despite the likelihood that mitigative measures vill recover water level before significant core damage occurs.- This anticipatory General-Emergency declaration threshold is consistent with the NUMARC guidance, with one conservative difference in that the PNPP EAL~does not require that the.

operators valt until the " Maximum Core Uncovery Time Limit" is exceeded before they declate the General' Emergency.

It is expected that.this final change should complete the review cycle on the' EAL revision, enabling NRC to issue an approval letter on~the attached -1 Emergency. Plan changes. Following receipt of the NRC letter and completion of 1 implementation actions, the Emergency Plan change vill be made effective and be submitted per 10 CFR 50 Appendix E.
